1. Agreement to these Terms
These Terms and Conditions (“Terms”) form a binding agreement between you and SALON LADIES AND SPA BOOKLY L.L.C., trading as “Bookly” (“Bookly”, “we”, “us” or “our”).
By accessing the website, downloading or using the mobile application, creating an account, listing services or making a booking, you confirm that you have read and agreed to these Terms and our Privacy Policy.
If you use Bookly for a company or other entity, you confirm that you have authority to bind that entity.
2. Bookly’s role
Bookly provides technology that allows customers to discover providers, compare available services, request appointments, make payments where enabled, receive reminders and manage bookings.
Providers are independent businesses or professionals. They are responsible for their licences, staff, premises, availability, descriptions, prices, service quality, hygiene, safety, customer care and legal compliance.
Bookly is not automatically a party to the service contract between a customer and a provider and does not employ, supervise or control independent providers, except where expressly stated.
3. Eligibility and account responsibilities
- You must have legal capacity to enter into these Terms.
- You must provide accurate, complete and current information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must promptly notify Bookly of suspected unauthorised access.
- You may not impersonate another person, create fraudulent accounts or transfer an account without approval.
A parent or legal guardian should create and manage appointments for a minor where legally required.
4. Additional terms for customers
Customers agree to:
- Provide accurate booking and contact information.
- Review the service description, duration, price, provider rules and cancellation conditions before confirming.
- Arrive on time and behave respectfully toward providers, staff and other customers.
- Disclose relevant information reasonably required for safe service delivery, such as allergies or contraindications, directly to the provider.
- Pay all properly disclosed charges associated with the booking.
- Use the complaint and support process honestly and provide requested evidence where reasonably necessary.
5. Additional terms for providers
Providers agree to:
- Maintain all licences, permits, approvals, insurance and professional qualifications required in the UAE and relevant emirate.
- Provide accurate business, staff, service, price, duration, availability and location information.
- Keep calendars and appointment slots current and honour confirmed bookings.
- Clearly disclose all material restrictions, additional charges and cancellation rules before booking.
- Provide services professionally, safely, hygienically and in accordance with applicable consumer, health and safety requirements.
- Protect customer information and use it only for legitimate booking and service purposes.
- Issue receipts or tax invoices where legally required.
- Handle complaints fairly and cooperate with Bookly’s support and investigation processes.
Bookly may request verification or compliance documents and may restrict visibility or access while reviewing a provider account.
6. Bookings and appointment confirmation
A booking request is subject to provider availability. A booking becomes confirmed when confirmation is displayed in the Platform or sent by email, SMS, push notification or another supported channel.
Customers should review confirmation details immediately. Providers must promptly notify customers of any inability to fulfil an appointment.
Service duration and start times are estimates and may be affected by reasonable operational delays. Material changes should be communicated as soon as possible.
7. Prices, fees and payments
- Prices must be displayed clearly in UAE dirhams unless another currency is expressly stated.
- Any taxes, booking fees, deposits or additional mandatory charges must be disclosed before confirmation.
- Payment may be collected online through an authorised payment processor or directly by the provider, depending on the booking.
- Bookly may charge providers subscription, commission, transaction, promotional or other fees under a separate provider plan or commercial agreement.
- Payment processing may be subject to the payment provider’s own terms.
Customers must not be charged an undisclosed amount. Providers remain responsible for the accuracy of prices and tax treatment.
8. Cancellations, no-shows and refunds
The cancellation and refund conditions shown before confirmation form part of the booking. Different providers or services may have different cancellation windows, deposit rules or no-show charges.
- A customer may cancel through the Platform where the option is available.
- A provider may apply a properly disclosed late-cancellation or no-show charge, subject to applicable law.
- If a provider cancels or cannot deliver the confirmed service, any prepaid amount for the undelivered service should normally be refunded or otherwise resolved in accordance with applicable law.
- Approved refunds are generally returned to the original payment method, subject to payment-provider processing times.
- Bookly may assist with communication and payment administration but may require information from both parties before determining a platform-related resolution.
The cancellation policy displayed for a specific booking will apply to that booking, provided it was clearly disclosed before confirmation and complies with applicable UAE law.
9. Services, safety and professional advice
Beauty, grooming and wellness services may involve individual sensitivities, allergies, contraindications or other risks. Customers should make their own informed decision and consult an appropriately qualified professional where needed.
Providers are responsible for conducting any necessary consultation, patch test, suitability assessment or consent process required for the service.
Content displayed on Bookly is for general information and booking convenience. It is not medical advice and must not replace advice from a qualified healthcare professional.
10. Reviews, images and user content
You may submit reviews, images, descriptions or other content where the Platform permits. You retain ownership of your content but grant Bookly a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display it for operating and promoting the Platform.
Content must be truthful, relevant, lawful and respectful. It must not infringe rights, reveal another person’s private information, contain hate, threats, harassment, obscenity, spam or misleading claims.
Bookly may moderate, reject or remove content that violates these Terms, applicable law or platform standards.
11. Prohibited conduct
You must not:
- Use Bookly for unlawful, fraudulent, deceptive or abusive activity.
- Manipulate bookings, ratings, reviews, prices, promotions or payment processes.
- Scrape, copy, reverse engineer, disrupt or attempt unauthorised access to the Platform.
- Upload malware or interfere with security, performance or availability.
- Use customer or provider information for unsolicited marketing or unrelated purposes.
- Bypass applicable Bookly charges through deceptive off-platform arrangements.
- List prohibited, unlicensed or misleading services.
12. Intellectual property
The Bookly name, logo, applications, website, software, interface, graphics, design, databases and original content are owned by or licensed to Bookly and are protected by applicable intellectual-property laws.
Bookly grants you a limited, revocable, non-exclusive and non-transferable right to use the Platform for its intended purpose. No ownership rights are transferred to you.
13. Privacy and data protection
Our collection and use of personal information is described in the Bookly Privacy Policy. Customers and providers must process personal information lawfully, securely and only for proper booking or service purposes.
14. Platform availability and changes
We aim to provide a reliable Platform, but uninterrupted or error-free operation is not guaranteed. Features may be updated, suspended or changed for maintenance, security, legal, technical or commercial reasons.
Bookly is not responsible for interruptions caused by telecommunications networks, app stores, payment providers, hosting services, force majeure events or systems outside its reasonable control.
15. Disclaimers and limitation of liability
Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded under UAE law.
To the maximum extent permitted by law, Bookly is not liable for the acts, omissions, advice, representations, service quality, safety, delays or cancellations of independent providers, or for disputes arising directly between customers and providers.
To the maximum extent permitted by law, Bookly will not be liable for indirect, incidental, special or consequential loss, loss of profit, loss of opportunity or loss of data arising from use of the Platform.
Where liability may lawfully be limited, Bookly’s aggregate liability relating to a booking will not exceed the amount of platform fees paid directly to Bookly for that booking, except where a different limitation is required by applicable law.
16. Indemnity
To the extent permitted by law, providers agree to indemnify Bookly against third-party claims, losses and reasonable costs arising from their services, premises, staff, listings, regulatory non-compliance, infringement or misuse of customer information.
This clause does not apply to the extent a claim was caused by Bookly’s own breach, negligence or unlawful conduct.
17. Suspension and termination
You may stop using Bookly at any time and may request account closure through available settings or support.
Bookly may suspend, restrict or terminate access where reasonably necessary to address fraud, safety concerns, legal requirements, non-payment, repeated complaints, material breach or risks to users or the Platform.
Where appropriate, Bookly may provide notice and an opportunity to respond. Terms that by their nature should continue will survive termination.
18. Governing law and dispute resolution
These Terms are governed by the federal laws of the United Arab Emirates and the applicable laws of the Emirate of Abu Dhabi.
Users should first contact Bookly support and provide a reasonable opportunity to resolve the issue. Nothing prevents a consumer from using an available consumer-protection complaint channel.
Subject to mandatory consumer rights, the courts of Abu Dhabi will have jurisdiction over disputes arising from these Terms.
19. Changes to these Terms
We may update these Terms to reflect changes to the Platform, business model or applicable law. Updated Terms will be posted with a revised date. Material changes may be communicated through the Platform or other appropriate channels.
Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.
